A presente dissertação propõe uma reflexão, do ponto de vista da diplomática judicial, sobre o funcionamento jurídico-processual e burocrático da Casa da Suplicação, o supremo tribunal português, entre 1446 e 1512. Partindo do estudo e análise das cartas de sentença, procurámos reconstituir os mecanismos de decisão e produção escrita deste tribunal. Na primeira parte da dissertação, problematizámos os conceitos de diplomática judicial e de documento judicial, focando-nos, depois, nas cartas de sentença. Na segunda parte, com base na legislação e no corpus documental definido, procurámos recriar a tramitação jurídico-processual de um litígio no tribunal superior, desde o impulso que o leva ao juiz até à decisão (actio) e sua execução, analisando também os perfis e competências dos julgadores do tribunal superior. Na terceira parte, tentámos revisitar os processos burocráticos, o quotidiano do tribunal e a actuação dos escrivães que conduzem à redução a escrito (conscriptio) do documento.
Abstract: This dissertation proposes a reflection, from the viewpoint of judicial diplomatics, on the procedural and bureaucratic functioning of the Casa da Suplicação, the Portuguese high court, between 1446 and 1512. Based on the study and analysis of sentences, we tried to reconstruct the decision-making and writing mechanisms of this court. In the first part of the dissertation, we discuss the concepts of judicial diplomatics and legal document, focusing afterwards on the sentences. In the second part, based on legislation and in the documental corpus set, we tried to recreate the legal procedure in the high court, starting with the petition that leads it to the judge and ending with the decision (actio) and its execution, also analyzing the profiles and skills of the high court’s magistrates. In the third part, we proposed to revisit the bureaucratic procedures, the everyday actions of the court and the scribes that lead to the writing (conscriptio) of the document.
