In the present work we intend to do an analysis of the production of electricity in special regime in Portugal. We will focus in particular in the remuneration system through the feed-in tariffs. First, we will excurse throughout different legal diplomas that regulated the special regime in Portugal, exploring which guarantees were conferred to electricity generators throughout the years. We intend to also evaluate how the producers remunerative rights were (or not) protected in the various legislative changes. In the second part of the dissertation we will examine whether the feed-in tariffs may be considered as State aid. Due to the inclusion of the subject in EU Law, we will analyze EU regulation and case law to support our position about the Portuguese regime. Finally, and to the extent that the production of electricity in special regime has undergone several changes to its remunerative regime in the last few years, we propose to analyze more carefully the amendments in question. We will scrutinize the reasons that based the amendments in question, which are mainly based on the economic crisis suffered by the country. We will also examine how those changes may jeopardize the remunerative rights of the producers.

Com este trabalho pretendemos elaborar uma análise do regime de produção de electricidade em regime especial em Portugal, sendo que o principal foco cairá no regime remuneratório através das tarifas garantidas ou feed-in. Para isso, num primeiro momento iremos elaborar um escurso pelos diferentes diplomas que regularam o tema em Portugal, analisando quais as garantias conferidas aos produtores de electricidade, e de que forma foram (ou não) salvaguardadas no âmbito das diferentes alterações legislativas. Numa segunda parte da dissertação iremos analisar se as tarifas feed-in se poderão considerar como auxílios de Estado. Devido à inclusão do tema no direito da União Europeia, iremos elaborar uma análise de alguns diplomas e de jurisprudência para sustentar a posição tomada quanto ao regime português. Por último, e na medida em que a regulação da produção em regime especial tem sofrido diversas mutações ao seu regime remunerativo, propomo-nos a analisar de forma mais cuidada quais as alterações em causa. Iremos analisar quais os motivos para a alteração das garantias remuneratórias dos produtores, sedeados principalmente na crise económica sofrida pelo país, e de que forma poderão essas alterações por em causa a garantia remuneratória dos produtores.
