O presente trabalho acadêmico pretende demonstrar a aplicação da mediação no contexto judicial ou fora dele. O principal objetivo é constatar a importância da capacitação do operador de direito e do advogado como atuantes no contexto mediatório, que já vem sendo aplicado em vários Tribunais do país, sendo uma alternativa a resolução de conflitos. Dada a relevância do assunto e a necessidade de implementação e aperfeiçoamento de técnicas autocompositivas que buscam desafogar o judiciário de demandas sócias, procurou-se abordar as principais nuances em torno do problema. Para isso, foram realizadas pesquisas, por intermédio de método dedutivo e qualitativo. Nota-se também que o referido método contribui para a criação de uma cultura de paz no Sistema Judiciário Brasileiro e incentiva a devida preparação dos profissionais.

The present monography intends to demonstrate the application of mediation in the judicial context or outside it. The main objective is to ascertain the importance of training the legal operator and the lawyer as active in the mediatory context, which has already been applied in several courts of the country, being an alternative to conflict resolution. Given the relevance of the subject and the need for implementation and improvement of self-compositional techniques that seek to relieve the judiciary of social demands, we sought to address the main nuances around the problem. For this, researches were conducted through deductive and qualitative method. It is also noted that this method contributes to the creation of a culture of peace in the Brazilian Judiciary System and encourages the proper preparation of professionals.
