A provisão da violência armada por parte de privados é algo que existe desde sempre. Vestefália mudou o paradigma centrando a legitimidade no estado-nação e nos exércitos do povo. O fim da Guerra Fria, com o desinvestimento nas Forças Armadas, o recrudescer do número de conflitos e o surgimento do conceito de New Public Management fazem novamente renascer este mercado. Assim, entidades privadas organizam-se procurando alterar o estigma inerente ao conceito de mercenário e criar uma estrutura legal e legítima para a condução das suas atividades crescendo em oferta de serviços, nos clientes para quem trabalham e nas áreas de operações. O presente trabalho, aborda as implicações das EMSP nas operações militares enquanto entidades condicionantes ou complementares das Forças Armadas. Tendo focado a recolha de informação ao período pós 11 de setembro de 2001, verificou-se a existência de diversos enquadramentos das EMSP em face dos serviços prestados e do nível de violência. Concluiu-se no desenrolar do trabalho que, segundo o modelo de Singer (2008), o papel condicionante ou complementar das EMSP é função de uma relação inversa entre a aceitabilidade, transparência e legalidade das atividades e o nível de violência passível de ser aplicada no cumprimento da missão contratualmente atribuída. Abstract: The provision of armed violence by private individuals is something that always exists. Westphalia changed the paradigm by focusing the legitimacy on the nation-state and the armies of the people. The end of the Cold War, with the disinvestment in the Armed Forces the increase in the number of conflicts and the emergent concept of New Public Management makes this market reborn again. Thus, private entities organize themselves seeking to change the stigma inherent to the mercenary and to create a legal and legitimate structure to conduct their activities growing in offer of services, in the clients for whom they work and in the areas of operations. The present work addresses the implications of PMSCs in military operations as conditioning or complementary entities of the Armed Forces. Having focused the collection of information to the post-September 11, 2001 period, there were several PMSC frameworks due to the provided services and the level of violence. It was concluded that, according to Singer's model (2008), the conditional or complementary role of PMSCs is a function of an inverse relationship between acceptability, transparency and legality of the activities performed and the level of violence that can be applied in the fulfillment of the contractually assigned mission.
