Female Genital Mutilation represents a deeply rooted form of gender discrimination and violence against women, extended nowadays to a total of ninety-two countries. Its core idea is based on a diminishing belief regarding the female gender, granting an eternal link between its social role and the goal of reproduction and family organization, perpetuating it as a preservation of ascendant’s cultural heritage.Thus, it perpetuates the idea that it is only with the mutilation of a female genital external organ that one achieves the clitoris’s mythical hygiene, bodily self-control (associated with promiscuity) and family’s honor.Established as a very risky and damaging practice for the health and even the life of all these girl-children and women who undergo it, the rationale of female genital mutilation embodies its own major obstacles such as religion, culture, and a lack of formal education regarding this subject.Therefore, with the practice’s globalization, there were some new challenges for the generation who had already undergone Female Genital Mutilation, facing two different inner challenges: one regarding maternity’s representations (which differ in cultures); and another one regarding their individual cultural identity. Throughout this paper we will thereby analyze the extension of the violation of equality’s principle through the practice’s motivations, as well as human right’s protective measures implemented globally, regionally, and domestically amongst relevant jurisprudence and meaningful present challenges.
A Mutilação Genital Feminina encapsula uma cultura enraizada de discriminação de género e violência contra as mulheres que se estende, atualmente, a um total de noventa e dois países. Na sua raiz, tem por base a criação de ideias e crenças diminutas do género feminino, atribuindo-lhe um papel social eternamente ligado à organização da família e reprodução, perpetuado por uma ideia de preservação da herança cultural de ascendentes.Para além disso, continua a ideia de que apenas através da mutilação do órgão genital feminino externo se alcança a higiene mítica do clitóris, a ideia de autocontrolo corporal (associado à promiscuidade) e a honra da família.É este o rationale que se encontra por detrás desta prática danosa para a saúde e vida das meninas e mulheres a que a ela forem submetidas, que como obstáculos ao seu fim tem desafios como a religião, a cultura e a lacuna de educação formal para o assunto.Ora, com a globalização da prática, foram por isso criados novos desafios para a geração já submetida, uma vez que se encontram perante dois conflitos internos: o de representações de maternidade (que diferem em culturas); e quanto à sua identidade individual cultural. Ao longo desta exposição, procuraremos por isso analisar a medida da violação do princípio da igualdade através das motivações da prática, assim como as medidas multinível de proteção de direitos humanos implementadas a nível global, regional e nacional, sua jurisprudência marcante e consequentes desafios atuais.
