A presente investigação visa descrever o papel da Guarda Nacional Republicana no âmbito do crime de Violência Doméstica, mais especificamente no âmbito da proteção de crianças e jovens em perigo, fruto da sua exposição ao crime perpetrado pelos seus progenitores ou de quem tenha a sua guarda de facto. As situações de violência, cujos agressores e vítimas mantenham ou tenham mantido uma relação de afeto, é definida como Violência Conjugal, diferenciando-se assim de um conceito mais abrangente como o de Violência Doméstica. No seguimento do objetivo central da investigação, fez-se a caracterização da articulação existente na Guarda Nacional Republicana, ao nível dos vários escalões e valências com competências nesta matéria específica, a identificação de particularidades processuais inerentes a ocorrências de Violência Doméstica que envolvam crianças ou jovens, a caracterização da articulação existente com entidades externas e a avaliação da formação dos militares neste âmbito. Em termos metodológicos foram seguidas três fases distintas: a exploratória, a analítica e a conclusiva. Enveredou-se por uma metodologia mista, combinando métodos qualitativos e quantitativos, aplicados ao estudo de caso do Comando Territorial de Lisboa. Como principais resultados, destaca-se o facto da Guarda Nacional Republicana desempenhar um papel fundamental no âmbito da prevenção e investigação de crimes de Violência Doméstica, e na proteção de crianças e jovens em perigo. A nível interno existe uma boa articulação entre os diversos escalões e valências que têm competência na matéria, e a nível externo destaca-se a qualidade da articulação existente com entidades como as Comissões de Proteção de Crianças e Jovens e as instituições da Rede Nacional de Apoio a Vítimas de Violência Doméstica. Em termos de formação dos militares, no âmbito de Violência Doméstica e Crianças e Jovens em Perigo, faz-se de uma forma global uma apreciação positiva. A Guarda Nacional Republicana desempenha um papel fundamental como entidade sinalizadora de situações de perigo que envolvam crianças e jovens, para as Comissões de Proteção de Crianças e Jovens em Perigo. De igual forma, desempenha um papel fundamental no atendimento das Vítimas de Violência Doméstica e no seu consequente encaminhamento para as instituições da Rede Nacional de Apoio a Vítimas de Violência Doméstica.
The present investigation aims to describe the role of the National Republican Guard in the context of the crime of Domestic Violence, specifically in the context of the protection of children and youngsters at risk, due to their exposure to the crime perpetrated by their parents or whoever has their custody. The situations of violence whose aggressors and victims have, or have had, a relationship of affection is defined as Conjugal Violence, thus differentiating itself from the more comprehensive concept of Domestic Violence. In the follow-up to the main goal of the investigation, a characterisation of the existing links in the National Republican Guard was made, at the level of the many ranks and valences with competences in this specific matter, an identification of the procedural particularities inherent to incidents of Domestic Violence involving children or youngsters, and also the characterisation of the existing links between the National Republican Guard and external entities and the training evaluation of the military in this context. In methodological terms, three distinct phases were followed: the exploratory, the analytical and the conclusive. A mixed methodology was embarked upon, combining qualitative and quantitive methods, applied to the case study of the Lisbon Territory Command. As main results, the fact that the National Republican Guard plays a key role in the field of the prevention and investigation of Domestic Violence and of the protection of children and youngsters at risk stands out. Internally, there is good coordination between the many ranks and valences with competences on the matter, and externally the quality of the existing coordination with entities such as The Children and Youngsters Protection Commisions and the institutions of the National Support Network of Victims of Domestic Violence stands out. In terms of the training of the miltary, in the context of Domestic Violence and Children and Youngsters at Risk, the evaluation is globally positive. The National Republican Guard plays a key role as a denouncing entity of danger situations involving children and youngsters, for the Children and Youngsters at Risk Protection Commissions. In the same way, it plays a key role in the support of Victims of Domestic Violence and on their consequent forwarding to the institutions of the National Support Network of Victims of Domestic Violence.
