A Legislação Tributária encontra-se dispersa por um vasto conjunto de diplomas visando a definição de um sistema tributário justo e socialmente aceite. O estudo desta ordem jurídica, que tutela uma importante parcela das receitas do Estado, reveste-se de especial interesse pois o combate à fuga aos impostos é o garante da justa repartição da carga tributária e da eficácia de um sistema tributário essencial para o crescimento e desenvolvimento económico de um país. O presente trabalho tem como finalidade identificar as principais lacunas na legislação tributária e expor as implicações destas no cumprimento da missão fiscal e aduaneira da Guarda Nacional Republicana, Neste sentido, para a realização do enquadramento teórico foi desenvolvida uma exaustiva pesquisa bibliográfica sobre a temática em questão e análise da legislação tributária no âmbito do cumprimento das atribuições da Guarda. Para a elaboração da parte prática realizaram-se entrevistas a Oficiais com reconhecido conhecimento na matéria em estudo e aplicaram-se questionários a todos os Comandantes de Destacamento Fiscal. Da investigação realizada conclui-se que existem nesta legislação algumas lacunas que em muito condicionam a actividade operacional da Guarda e que não têm merecido a importância devida da Instituição. Cumulativamente, a falta de formação adequada dos militares numa área de reconhecida exigência e de um órgão interno que se debruce sobre estas questões tem como resultado a diminuição da eficácia operacional do dispositivo.

Abstract Tax Legislation is scattered over an extensive pool of laws driving the attainment of a fair and socially accepted tax system. The study of this matter of law, which rules an important piece of the State revenue, is covered of special interest because the fight against taxes escaping is the guarantee for a fair share of tax duty and for an effective tax system, key to the growth and development of a country. This work has the purpose of identifying the main gaps on tax legislation and to expose their implications on perform tax mission of the National Republican Guard. For the accomplish of the theoretical framing it was developed an exhaustive bibliographical research over the theme and performed a tax legislation analysis in the context of the enforce of National Republican Guard missions. Several interviews, for the performing of the practical part of this work, was made to Officers with recognized knowledge on this matter,and applied questionnaires to all the Commanders of Fiscal Detachment. From the investigation it is conclude that there are in this legislation some gaps that stipulate too much the operational activity of the National Republican Guard and that have not deserved the proper concerning from Institution. Meanwhile, the lack of appropriate degree of the soldiers in a recognized particular area and the missing of an internal department that works up on these questions has as a result the decreasing of the operational efficiency of the device.
