O presente Trabalho de Investigação Aplicada está subordinado ao tema: A Gestão, o Controlo e o Destino das Viaturas Apreendidas pela Guarda Nacional Republicana. O objectivo que presidiu a sua realização foi a análise do processo decorrente de viaturas perdidas a favor do Estado e em final de vida, sob responsabilidade da GNR, assim como analisar a forma como é realizada a gestão das mesmas e os custos inerentes ao seu parqueamento e á sua remoção. Neste sentido procedeu-se ao levantamento da legislação vigente e á análise geral do dispositivo da Guarda. Sendo este processo extenso, burocrático, e aglutinador de meios humanos e materiais, dado que constitui uma parcela importante de actuação da Guarda Nacional Republicana que se reflecte em tempo e recursos dispendidos, humanos, financeiros e logísticos, é de elevada importância que seja alvo de análise e estudo. Neste contexto, surge o presente estudo partindo da questão central: É susceptível de ser rentabilizado e agilizado o processo de apreensão de viaturas, desde a sua efectiva apreensão até ao término do processo? Os objectivos definidos para este trabalho pretendem verificar as hipóteses formuladas a partir das questões de investigação levantadas, de forma a responder à questão central. Para tal, a metodologia utilizada para a realização do trabalho consistiu na análise documental de diversa legislação, estudos, pareceres, e na análise de entrevistas. Conclui-se que os normativos legais existentes quanto às responsabilidades sobre as viaturas apreendidas e abandonadas, são claros, no entanto, não existindo um órgão responsável só pelas viaturas em final de vida, e devido a imputarem os custos à entidade fiscalizadora, considera-se insuficiente para que resulte, por si só, numa desburocratização do processo e diminuição das despesas do Estado com as mesmas. Contudo, através de uma conjugação de esforços e do espírito de missão dos militares da Guarda, tem-se desempenhado as tarefas que a lei lhes atribui. Propõe-se um investimento na revisão da doutrina de actuação em relação às viaturas apreendidas e abandonadas, uma calendarização temporal dos processos, bem como a aquisição de reboques e constituição de parques.

Abstract This is a work of apploed research on the subject: Management, Control and the Future of the Seized Vehicles by the Guarda Nacional Republicana. The main purpose for its achievement was the analysis of the process of forfeited vehicles lost for the state and which are in the end of life, under the responsibility of the Guarda Nacional Republicana, and considers how their management is done as well as the cost of their parking and removal. In this way it was surveyed the existing legislation and the general analysis of the Guard device. This process is extremely wide, bureaucratic, and unifies human and material resources, as it is an important part of the action of the Guarda Nacional Republicana, and it is reflected in time and resources spent, as well as human, financial and logistics it is very important that is main target for analysis and study. In this context, the present study arises starting from the central question: Is it possible to make the process of the seizure of vehicles faster and profitable, from its seizure until the effective end of the process? The objectives set this work intended to verify the hypotheses formulated from the research questions, raised in order to answer the main question. The methodology used to write this work consisted of the analysis on various legislations, studies, opinions and documents as well as interview analysis. It was concluded that the existing legal and regulatory responsibilities on seized and abandoned vehicles, are very clear. However, as there is no single body responsible for the vehicles which are ending their life, and due to accredit the costs to the supervisory body, it is not enough to reduce the bureaucracy of the process and to decrease the costs by the State with them. Neverthless through a combination of efforts and spirit of the military mission of Guard, they have performed the assigned tasks by law. It is proposed investment in a revised doctrine of action in respect of seized and abandoned vehicles, a time schedule of processes, as well as the purchase of trailers and creation of parks.
