O presente relatório intitulado “Armamento e Equipamento na GNR: Níveis de Intervenção e Meios à Disposição”, é um estudo que procura avaliar qual o sistema de armas adequado ao militar da GNR tendo em conta os patamares do uso da força. Para a realização do presente estudo foi efetuado um enquadramento legal e conceptual, no qual se realizou uma abordagem teórica à legislação, aos diferentes patamares do uso da força e aos níveis de intervenção. Posteriormente forma aplicados questionários para avaliar a distribuição atual do armamento na GNR, em diferentes subunidades da instituição. Para além disso, analisou-se ainda lacunas e condicionalismos presentes na distribuição do armamento pelos militares, com o objetivo de identificar as necessidades que os militares se deparam no terreno aquando da atuação nos diferentes patamares do uso da força. A falta de meios materiais, conjugada com a atual crise económico-financeira, levanta alguns problemas a nível da gestão destes meios. Saber qual o material e equipamento necessário para cada missão e articular o material disponível em função das exigências do serviço e dos diferentes níveis de intervenção parece ser uma questão fundamental para a gestão dos meios, afetando não só a capacidade de resposta operacional aos incidentes bem como a imagem de profissionalismo da GNR. Com o presente trabalho concluiu-se que os militares devem ter acesso a um sistema de armas através do qual, independentemente das suas funções ou do nível de intervenção que atuam, possam pautar a sua conduta pelo respeito dos princípios da legalidade, necessidade e proporcionalidade. O necessário recurso à força, terá de ser o mínimo indispensável para atingir o seu fim. Para resolver determinada situação e sempre tendo a consciência de que o modo de atuação do militar, seja ele mais ou menos correto, irá influenciar o sentimento de segurança dos cidadãos. Logo, a existência de lacunas identificadas no sistema de armas dos militares, irá provocar o aumento da probabilidade de uma atuação menos correta, o que acarretará condicionalismos na atuação dos militares, na sua segurança dos cidadãos.

Abstract This report, entitled “Weaponry and Equipment in the GNR: Intervention Levels and Means Available”, is a study that aims to find out which weapons system is best suites to a military of the GNR, taking into account the different levels of use of force. To carry out this study, a legal and conceptual framework was made, in which a theoretical approach to legislation was made, at different levels of the use of force and to intervention levels that each military is associated with. Later, surveys were conducted in order to evaluate the current weapons distribution in the GNR, within the different subunits of the institution. Furthermore, we analyzed the gaps and constraints still present in the distribuition of weapons to the military, in order to identify the needs that the military face on the ground when acting at different levels in the use of force. The lack of material resources, combined with the current economic and financial crisis, raises some problems in the management of these resources. Knowing which materials and equipment are needed for each mission and accessing the material available depending on the service requirements and the different levels of intervention, appears to be a crucial issue for the management of resources, affecting not only the operational response to incidents as well as the GNR’s image of professionalism. It is concluded that the military should have access to a weapons system through which, regardless of their functions or the intervention level, can act guiding their conduct by the principles of legality, necessity and proportionality. So that if the use the force is necessary, this will be the minimum necessary to achieve its purpose. Always being aware that the military mode of action taken to solve a given situation will influence the sense of security of the citizens. Therefore, the gaps identified in the military weapons systems, will cause an increase in the probability of an incorrect action, which will entail the need for constraints on military action in maintaining the safety and security of the public.
