Este Trabalho de Investigação Aplicada está relacionado com a Investigação Criminal na Polícia do Exército, quando em missões de Polícia Militar Internacional. Para além de ser importante investigar crimes cometidos por Forças Nacionais destacadas, torna-se também necessário investigar crimes contra as nossas Forças, salvaguardando os militares e os interesses nacionais, que actualmente, existe a lacuna na legislação portuguesa de não estar previsto investigarem-se crimes cometidos contra as forças nacionais. A nível internacional, esta situação resolva -se através do estatuto das Forças e através de acordos com as autoridades locais se estiverem em condições para tal. Surge então a possibilidade da Polícia do Exército fazer investigação criminal quando integrada em Polícias Militares internacionais, tendo como referência a Polícia Militar da Organização do Tratado do Atlântico Norte e a Polícia Judiciária Militar. Para se proceder ao estudo desta situação o método aplicado foi o Dedutivo através da pesquisa e análise de informação qualitativa e quantitativa de documentos de fontes oficiais. Após exposição e análise de informação sobre a legislação aplicável, Polícias Militares e Métodos e Técnicas de Investigação Criminal conclui-se que a Polícia do Exército não deve adquirir a valência da investigação criminal por razões de custo-benefício.

Abstract The theme of this research is related to the criminal Investigation in the Army’s Military Police, while on missions to the international Military Police. Besides being important to investigate crimes committed by Deployed National Forces, it is also necessary to investigate crimes against Our Forces, maintaining the military and national interest, which currently, there is a gap in the national legislation that are not expected to investigate crimes committed against national Forces. Internationall y, this situation resolves itself through the status of the Forces agreement and the memorandum of understanding with the local authorities if they are able to do so. Then, comes the possibility of the Army’s Military Police to do criminal investigations when integrated into international Military Police, with the reference to the North Atlantic Treaty Organization Military Police and the Military Judicial Police. T carry out this Study the method applied was the Deductive through research and analysis of qualitative and quantitative information of documents from official sources. After exposure and analysis of information on the legislation, Military Police and the Methods and Techniques of Criminal Investigation, it is conclude that the Army’s Military Pol ice should not acquire the valence of the criminal investigation for reasons of cost -benefit analysis.
