A presente dissertação debruça-se sobre o tema do Princípio da Procura pela Verdade Material e na sua manifestação mais premente no Direito do Processo Laboral por comparação ao Direito do Processo Civil, tendo por referência a legislação vigente no ordenamento juridico português e as orientações da doutrina e jurisprudência. O estudo enfatiza a autonomia do processo laboral face ao processo civil, através do elenco de várias características diferenciadoras, todas elas manifestações práticas do Princípio da Procura pela Verdade Material, como é o caso da "Condemnatio Extra Vel Ultra Petitum", da possibilidade atríbuida ao juiz de ampliação da matéria de facto, da possibilidade de alargamento da base instrutória e da indagação oficiosa dos elementos da prova. É assim objeto desta dissertação, uma reflexão detalhada sobre as várias manifestações práticas do Princípio da Procura pela Verdade Material em processo laboral, embora o maior enfase seja atribuído ao estudo da Ação de Reconhecimento da Existência de Contrato de Trabalho. Para além de um estudo detalhado a todo o regime normativo desta ação e à razão do seu surgimento, propus-me a olhar para a posição dos Tribunais Superiores sobre a questão da inconstitucionalidade desta ação, sobre a posição e o papel do Ministério Público, sobre a possibilidade de desistência do trabalhador e as suas consequências práticas na ação e ainda sobre o prazo do atribuído ao Ministério Público para intentar a respetiva ação.
The present thesis relates to the Principle of Search for the Real Truth1 and its manifestation on the Labour Process Law in comparison with Civil Process Law, having by reference the Portuguese legislation and the opinions of doctrine and jurisprudence. Our work empathises the independence of Labour Process Law from Civil Process Law, by enlisting the aspects that differentiates one another, all of which are real-world manifestations of the Principle of Search for the Real Truth, as for instance the "Condemnatio Extra Vel Ultra Petitum", the grant of the judge of looking beyond the facts, the possibility of widening the state grounds and the search for further elements of proof on its own. Thus the scope of the present work is a detailed reflexion on the various real-world manifestations of the Principle of Search for the Real Truth, it focuses on the study of the Legal Action for the Recognition of a Work Contract. Besides a detailed study on all of the legal framework that regulates this type of lawsuit and its origin, I also looked into the stand of High Courts on the matter of unconstitutionality of this lawsuit, the role of the public prosecutor's office, the drop the of the legal action by the worker’s will and its practical consequences and finally the deadline granted to the public prosecutor's office to initiate the necessary steps for a lawsuit.
