Ao abordar o sistema processual penal brasileiro, este estudo contempla, criticamente, a ampliação das margens de consenso nele existentes. Atento às burocracias do contencioso, enfrenta o mito da obrigatoriedade da ação penal, desvelando sua mitigação no processo de diversão. Formula notas sobre a perspectiva do Ministério Público na atividade consensual penal, sem se descurar de abordar a participação ativa dos outros sujeitos processuais (juízes e advogados). Para tanto, enfrenta a manutenção do poder decisório e a preservação da imparcialidade na via consensual, bem como os reflexos práticos e ideológicos da atividade negocial no exercício da defesa. Apresenta críticas e ponderações sobre a proposta de alteração do Código de Processo Penal Brasileiro, mais especificamente no que diz respeito à ‘aplicação imediata de pena’. Examina os limites da renúncia aos direitos e às garantias fundamentais na relação processual penal consensual. Afirma a inexistência, em abstrato, de coação na aceitação dos acordos sobre sentença, observando a preservação da autodeterminação e da dignidade da pessoa humana. Levanta a existência de uma nova modalidade de verdade, a ‘verdade consensual’, e conclui pela conformidade jurídico-constitucional do negócio no processo penal brasileiro, indicando a necessidade de se efetivar, no caso concreto, a ponderação dos valores constitucionais em ‘jogo’. Enfrenta a problemática das abreviações de rito e a preservação do devido processo legal. Nega a ofensa ao primado da ‘presunção de inocência’ (nemo tenetur) na confissão sobre sentença. Traça um paralelo entre a busca pela eficiência e a exaltação da celeridade. Desnuda questões sobre culpabilidade, proporcionalidade e individualização da pena no consenso sobre sentença penal, identificando que a atividade negocial proporciona o fortalecimento dos fins da pena. Revela a impossibilidade de efetivação de julgamento antecipado da lide penal, em aplicação analógica do Código de Processo Civil (artigo 355 do CPC), enquanto não advier atividade legislativa reguladora no processo penal brasileiro. Por fim, contempla, criticamente, o instituto dos Juizados Especiais Criminais, percebendo o nascimento de um Ministério Público mais ‘flexível’. Tece, em sede conclusiva, considerações sobre a ‘colaboração premiada’, indicando aspectos éticos e morais que atormentam o aplicador do direito. Desse modo, conclui que o sistema processual penal posto não mais comporta a persecução uniforme de todas as violações de bens jurídicos penalmente tutelados, identificando que a ampliação das margens de consenso posta-se não só como alternativa útil, mas inafastável.
By approaching the Brazilian criminal procedure system, this study critically beholds the enlargement of the limits of consensus that exist within it. Attentive to contentious bureaucracies, it faces the myth of mandatory criminal prosecution by unveiling its mitigation in the informal concluding proceedings. It formulates notes about the perspective of the Public Ministry in the consensual criminal activity without neglecting to approach the active participation of the other procedural subjects (judges and lawyers). Therefore, it faces the maintenance of the decision-making power and of the preservation of impartiality in the consensual route, as well as the practical and ideological reflections of the negotiating activity in the defense exercise. It presents criticisms and considerations regarding the proposed amendment of the Brazilian Criminal Procedure Code, more specifically with respect to the ‘immediate application of the penalty’. It examines the limits of the renunciation of rights and of fundamental guarantees in the consensual criminal procedural relation. It affirms the inexistence, in abstract, of coercion in the acceptance of agreements on the sentence, by observing the preservation of self-determination and of the dignity of the human person. It raises the existence of a new modality of truth, the ‘consensual truth’, and decided for the legal and constitutional conformity of the negotiation in the Brazilian criminal procedure, by indicating the need to put into practice, in the concrete case, the consideration of constitutional values in question. It faces the problematic of abbreviation of the ritual and the preservation of the legal procedure in question. It denies the offense to the primacy of the ‘presumption of innocence’ (nemo tenetur) in the confession on the sentence. It describes a parallel between the search for efficiency and the praise of speed. It denudes questions on guiltiness, proportionality, and individualization of the penalty in the consensus on the criminal sentence, by identifying that the negotiating activity provides the strengthening of the purpose of the penalty. It reveals the impossibility of effectuation of anticipated judgement of the criminal labor, in analogical application of the Civil Procedure Code (Art. 355 of the Brazilian Civil Procedure Code), whilst a regulatory legislative activity in the Brazilian criminal procedure does not emerge. Lastly, it critically beholds the institute of Special Criminal Courts, by realizing the birth of a more ‘flexible’ Public Ministry. It traces considerations, in conclusive terms, about the ‘plea bargaining’, by indicating ethical and moral aspects which torment the applicator of the Law. Thereby, it concludes that the current criminal procedure system does not sustain the uniform prosecution of all violations of criminally protected legal assets, by identifying that the enlargement of the
