As recentes alterações da legislação processual penal visaram concretizar uma fundamental mudança de paradigma no que respeita ao papel desempenhado na instância criminal pelo titular do bem jurídico afectado. Recordando que o direito penal se destina à salvaguarda dos interesses primordiais da comunidade, estas modificações procuraram garantir o cumprimento desta função através da consagração de mecanismos de protecção dos titulares dos bens jurídico-criminais. Com esse intuito, conferiram um protagonismo sem precedentes à figura da vítima, atribuindo-lhe poderes efectivos de intervenção na lide. A adopção de um conceito legal de vítima e a previsão da sua participação em momentos relevantes do processo repercutir-se-á, inevitavelmente, na esfera jurídica do assistente. Como se intui, as duas noções revelar-se-ão tendencialmente coincidentes, assumindo todavia o assistente o estatuto de verdadeiro sujeito processual. Por esse motivo, importa averiguar se o CPP lhe confere um nível de tutela compatível com a inequívoca emergência de um direito à protecção da vítima no decurso da acção penal. Motivado por uma situação real, o presente estudo analisa esta questão a propósito das decisões relativas à aplicação de medidas de coacção. Em concreto, pretende determinar se o exercício do direito ao recurso autónomo pelo assistente, neste âmbito, constitui uma ferramenta essencial à efectivação do grau de tutela materialmente exigido. Com efeito, este contexto permite discernir, com especial acuidade, as reais necessidades de protecção da vítima, pondo a descoberto os perigos a que se encontra sujeita. Impõe-se, por isso, a consagração de vias processuais idóneas a garantir a respectiva segurança, evitando novas lesões do bem jurídico afectado. Como forma de alcançar tal desiderato, examinam-se os fundamentos e limites da intervenção deste sujeito na acção penal, perscruta-se a natureza e função das medidas de coacção e defende-se que não só o sistema processual penal, como também a ordem axiológica constitucional obrigam ao reconhecimento do direito de o assistente impugnar, judicialmente, uma decisão relativa à aplicação de medidas de coacção.
The recent modifications imposed to the Portuguese Criminal Procedural Code aimed to implement an essential change of paradigm regarding the position held, in criminal proceedings, by the person harmed by the offence. Recalling that the main purpose of criminal law is to protect society’s fundamental values, these amendments intended to ensure the fulfillment of such task by stating several means of protecting people damaged by the misconduct. In order to do so, an unprecedented prominence was recognised to the victim, granting her effective mechanisms to intervene in criminal proceedings. Establishing a legal definition for victim as well as giving her the possibility to take part in significant moments of the proceedings will undoubtedly impact on the party assisting the public prosecutor. As foreseeable, these two concepts will frequently refer to the same reality, only the latter being technically considered a subject in proceedings. Consequently, it is imperative to determine whether the level of safeguard provided by the Portuguese Criminal Procedural Code abides by the unquestionable emergence of this right to protection of victims during criminal investigations. Inspired by a real case, the current study addresses this question in the context of decisions imposing coercive measures. Specifically, its goal is to assess if the individual right of the party assisting the public prosecutor to lodge appeal against these rulings represents a fundamental tool to obtain the protection required. As a matter of fact, the demand to implement such measures thoroughly exposes the actual need to protect the victim, unveiling the risks she might be subject to. As a result, it is imperative to provide her with adequate means to ensure her safety, avoiding any ulterior damage. Therefore, this investigation analyses the conditions according to which the assistant may intercede in criminal proceedings, examines both the nature and the purpose of coercive measures and claims that not only Portuguese criminal law, but also the Portuguese constitutional system impose that the right to appeal against a decision concerning coercive measures be recognised to this subject in proceedings.
