As exigências legais e técnicas que encerra a atividade de investigação criminal, a par da evolução do fenómeno da criminalidade, provocam a necessidade de constante avaliação e adaptação da orgânica institucional, da gestão de recursos e de atos procedimentais. É neste âmbito de inevitabilidade e mudança que surge a investigação intitulada de “A Restruturação da Investigação Criminal na Guarda Nacional Republicana”. O presente trabalho tem como objetivo primordial, apurar o impacto das medidas implementadas com a nova estrutura de investigação criminal na eficácia operacional dos órgãos mais influenciados pela mesma. Desta forma, são analisados os principais benefícios e constrangimentos que a atual estrutura apresenta para os escalões estudados. Assim sendo, a metodologia utilizada nesta investigação tem por base a fase exploratória, analítica e conclusiva, pelo que os dados que sustentam toda a investigação foram obtidos através da realização de uma pesquisa bibliográfica, bem como, através da realização de entrevistas e um inquérito. Conclui-se que as alterações estruturais e procedimentais impostas, refletiram uma maior coordenação e proximidade entre todos os escalões da estrutura, um maior fluxo de informações, um acompanhamento e controlo da atividade em causa mais adequados, bem como uma melhor gestão e direcionamento do apoio aos núcleos operativos. Apesar desta evolução positiva, mantiveram-se e criaram-se determinados constrangimentos. Nesse âmbito, destacam-se a extinção das Equipas de Investigação e Inquérito, traduzindo-se num aumento de inquéritos nos Núcleos de Investigação Criminal, a par da redução de informações criminais; a falta de efetivo e de formação especializada; a necessidade de um maior investimento nas vertentes Operativa e Análise de Informações Criminais; assim como o afastamento do Comandante de Destacamento da estrutura de Investigação Criminal, sendo este Autoridade de Polícia Criminal. Por fim, é constatável a procura pela uniformização, cooperação e coordenação estruturais, onde o fator humano será sempre preponderante.

The legal and technical requirements terminating the criminal activity, along with the developments of the phenomenon of crime, cause the need for constant evaluation and adaptation of the institutional organic, resource management and procedural acts. It is in this context of inevitability and change that the research “The Restructuring of Criminal Investigation in the Republic National Guard” acquires special relevance. This work has as main objective to ascertain the impact of measures implemented with the new criminal structure in the operational effectiveness of the entities most affected by it. In this way, the main benefits and constraints that the current structure presents to the levels studied are analysed. Therefore, the methodology used in this research is based on the exploratory, analytical and final phase, so the data that sustain all research were obtained by conducting a literature research as well as through interviews and a survey. It is concluded that the structural and procedural changes imposed, reflected greater coordination and closeness between all levels of the structure, a greater flow of information, a better monitoring and control of the concerned activity as well as a better management and targeting of support to core operating. Despite these positive developments, some constraints remained and were created. In this context, there is the extinction of Research and Survey teams, leading to an increase in inquiries in Criminal Investigation Corps, together with the reduction of criminal information; the lack of police force police force and specialized training; the need for greater investment in Operations and Criminal Intelligence Analysis strands; as well as the withdrawal of the Detachment Commander from the Criminal Investigation structure, who is Criminal Police Authority. Finally, it is evident the demand for standardization, cooperation and structural coordination, where the human factor is always predominant.
