Esta dissertação tem como escopo analisar os limites materiais de Revisão Constitucional no Direito Angolano. Não existe tratamento sistemático atinente às limitações materiais de Revisão Constitucional no Direito Constitucional Angolano, por conseguinte, há carência de trabalhos que abordem especificamente este tema. A questão respeitante aos Limites materiais é um dos temas mais controvertidos da doutrina do Direito Constitucional, eles podem ser entendidos como sendo as matérias que a princípio não podem ser alteradas pelo poder de revisão no processo de Revisão Constitucional. Uma das hipóteses proposta é a de que os limites materiais apesar de terem como finalidade garantir a estabilidade constitucional nem sempre conseguem lograr tal aspiração. Dentro da discussão, depois de passar em revista a experiência doutrinária portuguesa e brasileira sobre a problemática dos limites materiais, vários pontos de discordância são levantados. No que ao Direito Angolano diz respeito este estudo debruça-se com maior incidência no processo de aprovação da atual Constituição da República, busca compreender o processo de alteração da Constituição que culminou com a aprovação do texto constitucional de 2010, procurando saber se houve ou não violação de limites materiais da Lei Constitucional de 1992. Mas antes disto procuramos perscrutar a nossa história constitucional, chegamos a conclusão de que ela teve início em Novembro de 1975, ainda que este texto constitucional não tenha consagrado expressamente limites materiais, é evidente que ele «carregava» limites materiais implícitos que o Legislador Constitucional tinha a obrigação de respeitar. Ainda no que concerne a História, não restam dúvidas de que os limites materiais expressos de Revisão Constitucional foram consagrados pela primeira vez no texto constitucional de 1992.
The scope of this dissertation is to analyse the material limits of the Constitutional Revision in the Angolan Law. There is no systematic treatment in what respects the material limitations of the Constitutional Review in the Angolan Constitutional Law; therefore there is the need to work specifically on this subject. The question that regards the material limits is one of the most controversial subjects of the doctrine of the Constitutional Law, as they can be understood as being the matters that cannot be modified by the power of revision in the Constitutional Review process. One of the proposed hypothesis is that the material limits, although their purpose is to grant the constitutional stability, cannot always accomplish such an end. After reviewing the portuguese and brasilian doctrinary experience in this matter, there was disagreement on many points within the debate on material limits. Regarding the Angolan Law, this study focuses strongly on the approval process of today's Republic's Constitution, searches to understand the process of amending the Constitution, that reached its peak with the approval of the constitutional text of 2010, trying to know if there was or not a violation of the material limits of the Constitutional Law of 1992. But before this, we wanted to explore our constitutional history, and we concluded that it had its beginning in November 1975, even if this constitutional text hasn't clearly established material limits, it is evident that it “involved” implicit material limits that the Constitutional Legislator was obliged to respect. Still in what respects History, there is no doubt that the material limits of the Constitutional Review were established for the first time in the constitutional text of 1992.
