Child trafficking hasn’t always been known to the extent it holds today. Throughout history, the need to legislate particularly on the matter of child trafficking became real. However, due to the absence of specific laws, it was incorporated into two other crimes: human trafficking – on the international scene – and the prostitution of children – on the national scene. Not only after the 2007’s penal code reform, did the legislator regulate the crime of child trafficking. Internationally, there were created several legal instruments such as the Convention on the Rights of the Child and the Protocol to Prevent, Suppress and Punish Trafficking in Persons, especially Women and Children. These instruments reflected upon the Portuguese’s legal system, as well as the Spanish’s and the Italian’s, and forced the member States to legislate accordingly. Alongside with the new legislation it became necessary to differentiate the crime of child trafficking from other similar crimes, such as aiding illegal immigration. Today, the fight against child trafficking follows a procedure with extraordinary characteristics, for it is committed by highly organized criminals. It begins with the identification of the victim and comes to an end with the sentencing of the perpetrators. Currently, the refugee crisis is one of the greatest concerns of the international community. Not only are refugees arriving in the European borders in great numbers, but it is also believed that the trafficking organizations are operating on the refugees themselves. Therefore, the main goal of this dissertation is to analyze the characteristics of both national and international laws and regulations on child trafficking.
Nem sempre o Tráfico de Menores foi reconhecido com a real importância que detém. Ao longo do tempo, tornou-se clara a necessidade de criar disposições específicas para o Tráfico de Menores. Na falta destas disposições, a criminalização do tráfico de menores foi incluída, a título de exemplo, no tráfico de pessoas, quando operado a nível internacional, e no lenocínio de menores, quando reportada a nível interno. Só após a reforma do Código Penal de 2007 é que o legislador consagrou o tráfico de menores. No que concerne à ordem internacional, assistimos à criação de diversos instrumentos jurídicos internacionais, nomeadamente a Convenção sobre os Direitos da Criança e o Protocolo Adicional Relativo à Prevenção, à Repressão e à Punição do Tráfico de Pessoas, em especial de Mulheres e Crianças. A criação destes instrumentos, que se refletiu não só no ordenamento jurídico português como no espanhol e italiano, levou os Estados-Membros a introduzir, nos seus ordenamentos jurídicos, disposições semelhantes às constantes nos referidos instrumentos de cariz internacional. A par das mudanças legislativas, tornou-se, ainda, necessário proceder à distinção do tráfico de menores de outros crimes, que podem muitas vezes ser confundidos, tal como acontece com o Auxílio à Imigração Ilegal. Desta forma, o combate ao Tráfico de Menores encontra-se vinculado a um procedimento específico, com características excecionais, pois este é praticado pela criminalidade altamente organizada. O referido procedimento inicia-se com a sinalização da vítima e irá culminar com a efetiva condenação dos agentes do crime de tráfico de menores. A crise dos refugiados é neste momento uma das maiores preocupações da comunidade internacional. A par do crescente número de refugiados a chegar às fronteiras do continente europeu, acresce a preocupação pela possibilidade de as redes de tráfico estarem a traficar menores refugiados. Em suma, propusemo-nos realizar uma análise ao que se encontra legislado, mencionando as especificidades do tráfico de menores, tanto a nível nacional como internacional.
