O presente estudo tem por objetivo analisar a inefetividade da legislação aplicada ao setor de radiodifusão no Brasil, podendo ser afirmado que, frente à inefetividade em questão, os serviços de radiodifusão aqui se encontram num patamar de “autorregulação”. Para tanto, será realizada uma perspectiva comparada com o novo marco legal argentino, país vizinho que apresenta um setor de radiodifusão similar ao brasileiro e, principalmente, que possui um histórico de resistência à implantação de um processo de regulação eficiente. Contrapondo ao ambiente de “autoregulação” e de interferências políticas, a Teoria Processual Administrativa surge como alternativa para construção de um modelo de regulação voltado a atender o interesse público. _____________________________________________________________________________ ABSTRACT
This study to analyze the ineffectiveness of the legislation applied to the broadcasting sector in Brazil and could be stated that, faced with the inefficiency in question, broadcasting services here are a level of "self-regulation". To do so, a comparative perspective with the new Argentine legal framework will be held, a neighboring country that has a broadcasting industry is similar to Brazil and, especially, which has a resistance to the historical implementation of an efficient regulatory process. In contrast to the environment of "selfregulation" and political interference, the Administrative Procedure Theory is an alternative to building a regulatory model geared to serve the public interest.
