No presente estudo foi realizada uma pesquisa qualitativa com 20 mães e 16 pais, bem como com três psicólogos e uma deputada federal, com a finalidade de evidenciar a necessidade de regulamentação e ampliação do instituto da licença-paternidade, que ainda é regulado por norma de caráter provisório, isto é, pelo § 1º, do artigo 10 dos Atos de Disposições Constitucionais Transitórios, apesar de há quase 30 anos, a Constituição Federal ter determinado a criação de lei específica que regulamentasse essa licença. Em decorrência desse fato, foi demonstrado como a ausência de regulamentação e por sua vez a manutenção de um período exíguo de licença-paternidade, reflete na diminuição da possibilidade do exercício da paternidade ativa e na manutenção da divisão sexual do trabalho e do preconceito de gênero.

On the present study, a qualitative research will be conducted with twenty mothers and sixteen fathers, as well as with three psychologists and a congresswoman, in order to show the need for regulation of provisional nature, i.e., by paragraph 1 of article 10 of the Acts of Transitional Constitutional Disposition, even though 30 years ago the Constitution determined the creation of specific law to regulate the paternity leave. Due to this fact, it will be demonstrated how the absence of regulation and the maintenance of an exiguous period of paternity leave can reflect on the reduction of the possibility of exercise of active paternity, leading also to the maintenance of gender-based work division and gender prejudice.
