O presente trabalho tem como objetivo a realização de pesquisa empírica para verificar e dimensionar a variabilidade dos critérios utilizados pelo Superior Tribunal de Justiça, nos julgamentos de recursos que versam sobre a alteração dos valores determinados para as astreintes. A pesquisa consistiu na análise e interpretação dos acórdãos proferidos sobre a possibilidade de alteração dos valores das astreintes nos três anos anteriores ao julgamento do Agravo em Recurso Especial Nº 738.682/RJ, realizado em novembro de 2016, que apontou divergência nos critérios de julgamento entre diferentes Turmas do STJ, seguida da sistematização e tabelamento dos dados obtidos. A partir da interpretação desses dados, foram apresentadas as constatações sobre o problema.
This study aims to carry out empirical research to assess and verify the variability of the criteria used by the Brazilian Superior Court of Justice to judge appeals that request alteration of the values determined for fines (astreintes). The research consisted of the analysis and interpretation of the judgments given on the possibility of altering the values of fines (astreintes) in the three years prior to the judgment of the appeal numbered 738.682/RJ, which was held in November 2016, and showed distinctions on the criteria used by different judgments held by of the Superior Court of Justice, followed by the systematization and tabulation of the data obtained. From the interpretation of the data, the problem was assessed.
