O presente trabalho visa analisar a atual perspectiva do graffiti em centros urbanos, aliado à sua capacidade de transformação da cidade, enunciando direitos fundamentais constitucionais, notadamente aqueles relacionados à liberdade de expressão e à cidade. Para este propósito, o referido fenômeno é analisado como novo movimento social, capaz de criar direitos decorrentes de lutas sociais urbanas, bem como é examinado o tipo de cidadania denunciada por estes movimentos de intervenção artística. Este entendimento se deu mediante à leitura de variados textos acadêmicos e realização de entrevistas participantes com grafiteiros e grafiteiras do Distrito Federal. Não obstante, considerada a perspectiva de proteção de direitos, tal prática segue tipificada como crime pelo ordenamento brasileiro. Assim, investiga-se como os agentes inseridos no fenômeno veem tal ação repressiva e o tratamento que é dado pela lei. O que é sugerido por tal pesquisa, ao final, é que importante para o graffiti que este continue um procedimento ilegal, ainda que o tratamento jurídico seja problematizado pelos agentes.
The present paper aims to analyze the actual perspective of graffiti in urban centers, allied with the capacity of transformation of the city, enunciating fundamental and constitutional rights, notably those relating to free expression and to the city. For that purpose, the referred phenomenon is analyzed as a new social movement, capable of creating rights originating from the social and urban struggles, as well as what kind of citizenship denounced by those movements of artistic intervention is also examined. That understanding was due to the reading of varied academic texts and the realization of participative interviews with the graffiti artists of the Federal District. Nevertheless, taking into account the perspective of protection of rights, such practice is still typified as a crime by the brazilian framework. In that sense, the way that the agents inserted in the phenomenon see such repressive action and the treatment given by the law are investigated. What is suggested by the research, in the end, is that it is important for graffiti that it continues as an illegal procedure, even though the juridical treatment is problematized by the agents.
