O fenômeno da globalização trouxe grandes impactos na seara laboral. Alguns, nefastos, têm acelerado o processo generalizado de desmonte do Direito do Trabalho. Com a abertura dos mercados, empresas se deslocam no globo em busca de locais em que a legislação trabalhista é inexistente ou pouco protetiva, ocasionando o fenômeno do dumping social. Os países, para se manterem atrativos, se veem obrigados a lançar mão de suas políticas laborais e sociais, gerando um nivelamento por baixo dos respectivos direitos. Esta prática tem gerado um processo de flexibilização do Direito do Trabalho com consequente agressão à dignidade do trabalhador. O Direito do Trabalho, sendo meio de inserção social, de acesso à democracia, de distribuição de renda e cidadania, deve ser fortalecido. Para que todos os trabalhadores tenham garantido um trabalho digno e decente, devem ser assegurados, em todos os níveis normativos, meios de efetivação de um patamar razoável de direitos trabalhistas. Muitas têm sido as tentativas nessa direção, seja por meio da intervenção das instituições que compõem as estruturas estatais de proteção do trabalho e do trabalhador, seja por meio das organizações internacionais. Entretanto, milhares de trabalhadores, de diversas partes do mundo, ainda são submetidos a condições precárias, inseguras e insalubres de trabalho. Há um cenário crônico de inefetividade do Direito do Trabalho, sendo imperioso resistir a esse processo universal de desmantelamento dos direitos laborais. Muitos são os desafios contemporâneos de um mundo do trabalho em crise, entretanto há que se estabelecer um arcabouço de direitos e assegurá-los a todos, independentemente de sua origem, cultura, sexo, cidadania: um patamar aceitável de direitos universais. A partir dessa abordagem, a pesquisa analisará o processo global de desconstrução do Direito do Trabalho. O objetivo central deste estudo é comprovar a necessidade da redefinição dos instrumentos para oposição e reação a esse processo. Para enfrentamento da temática, adotou-se o método jurídico-sociológico, analisando a história das relações laborais, as dimensões do Direito do Trabalho, as instituições de tutela dos direitos laborais nos multiníveis existentes e sua efetividade, por meio de amplo levantamento teórico e investigativo. Ao final, defende-se que as soluções devem ser globais pois os desafios postos têm a mesma magnitude. Faz-se iminente um ordenamento jurídico internacional adequado, no qual sejam estabelecidos, e assegurados, direitos humanos trabalhistas universais, dotados de efetividade. The phenomenon of globalization has brought great impacts to the labor market. Some of those obscure effects have accelerated the generalized process of dismantling Labor Law. With the opening of markets, companies have been moved around the globe in search of places where labor legislation is non-existent or insufficient, causing the phenomenon of social dumping. Countries, in order to remain "attractive", are obliged to use their labor and social policies, creating a leveling off under their respective rights. This practice has generated a process of labor law flexibilization with consequent aggression to the dignity of the worker. Considering that the Labor Law is a means of social insertion, access to politics and democracy, income distribution and citizenship, it must, therefore, be strengthened. In order to all workers to have guaranteed decent and worthy work, those means must be ensured, at all normative levels, of achieving reasonable level of labor rights. Many attempts have been made in this direction, either through the intervention of the institutions that make up state structures for the protection of labor and the worker, or through international organizations. However, thousands of workers from all over the world are still subjected to precarious, insecure and unhealthy working conditions. There is a chronic scenario of labor law ineffectiveness, and it is imperative to resist this universal process of dismantling labor rights. There are many contemporary challenges of a world with work in crisis; however, a framework of rights must be established and ensured to all, regardless of origin, culture, sex, citizenship: an acceptable level of universal rights. From this approach, the research will analyze the overall process of deconstruction of Labor Law. The central objective of this study is to prove the need to redefine the instruments for opposition and reaction to this process. To deal with this issue, the legal-sociological method was adopted, analyzing the history of labor relationship, the dimensions of Labor Law, the institutions for safeguarding labor rights in existing multi-levels and their effectiveness, through a broad theoretical and investigative survey. In the end, it is argued that solutions must be global because the challenges posed have the same magnitude. Appropriate international legal order is imminent, in which universal and effective human labor rights are established and guaranteed. Keywords: Globalization. Labor Law. Social Dumping.
