The climate emergency poses unprecedented challenges for the Law. Several decades since the adoption of the first legal instruments on climate change, the planet’s biogeophysical conditions are deteriorating at an accelerated pace. Faced with this dissonance, the juridical field has experienced a disruptive phenomenon, whereby various actors seek to fill the gap in effectiveness: the radicalisation of climate litigation. Given this context of disruption, both in the climate system and in the legal system, this research seeks to delve into the intersection between the two fundamental issues that emerge: on the one hand, the question of the legal response to the climate emergency; and, on the other hand, the question of the influence of the climate emergency on the legal field. Starting from an understanding of climate change as a question of justice, radical climate litigation is analysed as a phenomenon that reveals a broader narrative dispute surrounding the “monopoly of the right to determine the law”. The limits of this type of strategic litigation highlight, in an unparalleled way, the limits of the modern-liberal legal paradigm itself, upon which contemporary legal systems are built. It is therefore clear that juridicity, as it is currently articulated and developed, suffers from a congenital ecological flaw, as it is unable to effectively address the climate emergency because it does not curb the underlying dynamics responsible for climate injustice. Recognising this insurmountable anomaly in the current legal paradigm, this research ultimately aims to lay the foundations for an alternative paradigm capable of bringing about the necessary systemic transformations. It is in the context of this reflection that the principle of the common emerges as a dialectical alternative to the possessive individualism of the modern-liberal paradigm.
A emergência climática coloca ao Direito desafios sem precedentes. Volvidas várias décadas desde a aprovação dos primeiros instrumentos jurídicos em matéria climática, o agravamento das condições biogeofísicas do planeta verifica-se de forma acelerada. Face a esta dissonância, o campo jurídico tem conhecido um fenómeno disruptivo, por via do qual diversos atores procuram colmatar a lacuna de efetividade verificada: a radicalização da litigância climática. Perante este quadro de disrupção, quer do sistema climático quer do ordenamento jurídico, o presente trabalho procura mergulhar no espaço de interseção entre as duas questões fundamentais que emergem: por um lado, a questão da resposta jurídica à emergência climática; e, por outro lado, a questão da influência da emergência climática sobre o campo jurídico. Partindo da compreensão das alterações climáticas como problema de justiça, analisa-se a litigância climática radical como fenómeno que denuncia uma disputa narrativa mais alargada em torno do “monopólio do direito de dizer o Direito”. Os limites dessa modalidade de litigância estratégica evidenciam, de forma ímpar, os limites do próprio paradigma jurídico moderno-liberal sobre o qual estão edificados os ordenamentos jurídicos contemporâneos. Torna-se, deste modo, indubitável que a juridicidade, tal qual se encontra articulada e desenvolvida, padece de uma falha ecológica congénita, não sendo capaz de, efetivamente, endereçar a emergência climática porquanto não refreia as dinâmicas responsáveis pela injustiça climática. Reconhecendo esta anomalia insuperável do paradigma jurídico vigente, o presente trabalho assume, por fim, o desiderato de idear os alicerces de um paradigma alternativo, capaz de operar as necessárias transformações sistémicas. É no quadro dessa reflexão que emerge o princípio do comum, enquanto alternativa dialética ao individualismo possessivo do paradigma moderno-liberal.
