O presente trabalho visa, essencialmente, refletir sobre o tema da Segurança e Saúde no Trabalho no âmbito das relações jurídico-laborais. Toda a atividade laboral comporta risco, pelo que toda a gestão estratégica dos recursos humanos deve ser traçada tendo por base a segurança e saúde do trabalho. Constitui hoje um direito de qualquer trabalhador, reconhecido constitucionalmente o “direito ao trabalho em condições dignificantes” onde a análise, a gestão, e o controlo dos riscos associados ao ambiente de trabalho assumem um papel preponderante. Para o garantirem as organizações obrigam-se a adotar as medidas de prevenção e proteção que do ponto de vista legal sejam imprescindíveis para assegurar a organização da segurança e saúde no trabalho. A ONU, a OIT, a UE e o Estado Português têm contribuído para a promoção da cultura preventiva de segurança e saúde em contexto de trabalho com a publicação de convenções e instrumentos legislativos no sentido de alcançar um ambiente de trabalho saudável e são.

The main aim of this paper is to reflect on the issue of Safety and Health at Work in the context of legal and labor relations. All work involves risk, so all strategic management of human resources must be based on occupational health and safety. It is now a constitutionally recognized right of every worker to “work in dignified conditions” where the analysis, management and control of the risks associated with the working environment play a key role. To guarantee this, organizations are obliged to adopt the preventive and protective measures that are legally essential to ensure the organization of safety and health at work. The UN, the ILO, the EU and the Portuguese state have all contributed to promoting a preventive culture of safety and health at work by publishing conventions and legislative instruments aimed at achieving a healthy and healthy working environment.
