Artificial intelligence in medicine: foundations for a no-fault liability and compensation regime

Portuguese medical liability law rests on a structural assumption that artificial intelligence in clinical settings renders unsustainable: the existence of an identifiable human agent whose conduct can be measured against a standard of personal care. Algorithmic opacity renders the lex artis indeterminate; information asymmetry prevents causal reconstruction; and the chain between provider and deployer lacks a rule for internal apportionment. The withdrawal of the proposed European directive on civil liability for AI in October 2025, without resolving the gaps it was designed to address, transferred to national legal orders the responsibility of filling them. This article establishes the foundations for a specific national statute to occupy that space, built on two pillars. The first comprises five normative proposals derived from the obligations of Regulation (EU) 2024/1689: documented critical evaluation as the operative content of the lex artis; a rebuttable presumption of causal contribution; an internal apportionment rule based on regulatory functions; extension of informed consent to the system’s participation; and the inapplicability of the development-risk defence to systems with autonomous learning. The second is a sectoral compensation fund capitalised by operators of high-risk AI systems in healthcare, grounded in risk-benefit logic and covering harm caused by compliant systems; it is configured as the primary compensation regime, with the five proposals operating as a recourse instrument.

O regime português de responsabilidade civil médica assenta num pressuposto que a inteligência artificial em contexto clínico torna estruturalmente insustentável: a existência de um agente humano identificável cuja conduta é comparável com um padrão de diligência pessoal. A opacidade algorítmica torna a lex artis indeterminada; a assimetria de informação impede a reconstituição do nexo causal; a cadeia entre prestador e responsável pela implantação carece de regra de distribuição interna. A retirada da proposta de directiva europeia sobre responsabilidade civil por IA em Outubro de 2025, sem que as lacunas identificadas tivessem sido resolvidas, transferiu para os ordenamentos nacionais a responsabilidade de as colmatar. O artigo propõe as bases de um diploma específico de direito nacional que ocupe esse espaço, assente em dois pilares. O primeiro compreende cinco propostas normativas derivadas das obrigações do Regulamento (UE) 2024/1689 (AI Act): avaliação crítica documentada como conteúdo da lex artis; presunção ilidível de contributo causal; regra de distribuição interna baseada nas funções regulatórias; extensão do consentimento informado à participação do sistema; e inaplicabilidade da defesa pelo risco de desenvolvimento a sistemas com aprendizagem autónoma. O segundo é um mecanismo de compensação sectorial capitalizado pelos operadores de sistemas de alto risco em saúde, cuja arquitectura assenta na lógica risco-benefício e cobre os danos causados por sistemas conformes; configura-se como regime principal, com as cinco propostas a funcionar como instrumento de regresso.
