Neste artigo pretendo sumariar a comunicação apresentada no XVIII Encontro de Professores de Direito Público, em setembro de 2025, e refletir sobre os desafios da gestão da água (no que respeita a quantidade e a qualidade de água disponível) e o contributo do Direito Administrativo para alcançar uma gestão da água que protege as bacias hidrográficas e que serve de meio para a sustentabilidade. Para esse efeito, enuncia-se a situação de facto relativa à importância da gestão da água para a vida humana e para o contexto português. De seguida, analisam-se os instrumentos de Direito Administrativo (regulamento administrativo, ato administrativo, contrato administrativo e soft law) à luz do objetivo último da garantia da sustentabilidade e, sequencialmente, da boa gestão da água no território nacional, tendo por base o caso do Algarve. Por último, apresenta-se conclusões da análise efetuada.
In this article, I aim to summarise the communication presented at the XVIII Meeting of Public Law Professors in Portugal, in September 2025, and to reflect on the challenges of water management—both in terms of the quantity and the quality of available water—and on the contribution of Administrative Law to achieving water governance that protects river basins and supports sustainability. To that end, the article outlines the factual context concerning the importance of water management for human life and for the Portuguese setting. It then examines the instruments of Administrative Law (administrative regulation, administrative act, administrative contract and soft law) in light of the ultimate goal of ensuring sustainability and, consequently, the sound management of water resources in the national territory, drawing on the case of the Algarve. Finally, the article presents the conclusions resulting from this analysis
