The ruling of the Court of Justice (Third Chamber) of February 24, 2022, in the case between CJ and the Tesorería General de la Seguridad Social (TGSS), focuses on a current issue: the (lack of) social protection in unemployment for domestic workers and the potential indirect discrimination arising from it. In a highly feminized sector such as domestic work, the negative impact of certain legal provisions is likely to disproportionately affect women. Since the case concerns the protection guaranteed by a legal social security system against the risk of unemployment, the question arises whether this disparity in impact conflicts with Council Directive 79/7/EEC of December 19, 1978.

O Acórdão do Tribunal de Justiça de 24 de fevereiro de 2022 (C- -389/20), que opõe CJ à Tesorería General de la Seguridad Social (TGSS), tem como foco um assunto da ordem do dia entre nós: o da (des)proteção social no desemprego dos trabalhadores do serviço doméstico e a eventual discriminação indireta daí decorrente. Num setor altamente feminizado, como é caso do serviço doméstico, o impacto negativo de determinadas disposições legais é suscetível de afetar particularmente as mulheres. Estando em causa a proteção garantida por um regime legal de segurança social contra o risco de desemprego, coloca-se a questão de saber se essa disparidade de impacto colide com a Diretiva 79/7/CEE do Conselho, de 19 de dezembro de 1978.
