The intention of the article is not so much take over the theses of natural law contained in the work of John Finnis, while all the time they are present, but only to outline the methodological choice of the author. What was the claim of methodological John Finnis to write and publish Natural Law and Natural Rights? Perhaps the author gives us the best clue when he writes that the choice of the analytical theory of law came before the option of natural law. Choose which placed partly in the tradition of his mentor Herbert L. A. Hart, who recognizes the invaluable contributions to the conceptualization of law, especially the descriptive power of analytic theory. Thus, like Hart, Finnis took hard linguistic accuracy and the intrinsic difficulties of the analytical tradition.

A intenção do artigo não é tanto retomar as teses de direito natural contidas na obra de Finnis, embora a todo momento elas estejam presentes, mas unicamente apresentar em linhas gerais a escolha metodológica do autor. Qual foi a pretensão metodológica de John Finnis ao escrever e publicar Natural Law and Natural Rights? Talvez o próprio autor nos ofereça a melhor pista ao escrever que a escolha da teoria analítica do direito veio antes da opção do jusnaturalismo. Escolha que o colocou em parte na tradição de seu mestre eorientador Herbert L. A. Hart, a quem reconhece inestimáveis contribuições à conceituação do direito, principalmente pelo poder descritivo da teoria analítica. Desse modo, a exemplo de Hart, Finnis assumiu com afinco o rigor linguístico e as dificuldades intrínsecas da tradição analítica.
