Este trabalho se propõe a analisar a forma mais severa de intervenção estatal no âmbito familiar: a suspensão e destituição do poder familiar. Em proteção à criança e adolescente, determina-se que, caso venham os pais a descumprirem seus deveres de resguardar pela proteção dos menores de modo integral, agindo de forma negligente, violenta, cruel ou exploratória, deverão ter o poder familiar suspenso ou até mesmo destituído, de modo que, ameaçada a segurança do filho, o Poder Público está legitimado a intervir, afastando o menor do convívio dos pais. Casos como estes são extremamente delicados e indicam, na maioria das vezes, situações de fragilidade emocional, econômica e/ou social da família como um todo, de modo que os efeitos recaem sobre todos os indivíduos, porém são ainda mais lesivos aos menores inseridos no convívio familiar. As decisões judiciais que definem o futuro da família exigem do magistrado muito mais do que aplicar a lei ao caso, sendo imprescindível uma análise humana, zelosa e comprometida com a justiça. Por isso, partindo-se de uma breve análise histórica da construção e afirmação do Direito da Criança e do Adolescente, bem como da transição entre o pátrio poder e o poder familiar, estudou-se o regramento atual deste instituído para o fim de construir uma base sólida à compreensão da função da autoridade parental e dos princípios que regem este encargo imposto aos genitores.
This paper proposes to analyze the most severe form of state intervention in the family sphere: the suspension and removal of family power. In order to protect children and adolescents, it is determined that, if parents fail to fulfill their duty to protect the minors in full, acting in a negligent, violent, cruel or exploitative way, they must have the family power suspended or even destituted, so that, threatened the safety of the son, the Public Power is legitimated to intervene, removing the minor from the parents' coexistence. Cases like these are extremely delicate and indicate, in most cases, situations of emotional, economic and / or social fragility of the family as a whole, so that the effects fall on all individuals, but are even more harmful to minors inserted in the family. family life. The judicial decisions that define the future of the family require from the magistrate much more than applying the law to the case, and a human, zealous and committed to justice analysis is essential. For this reason, starting from a brief historical analysis of the construction and affirmation of the Law of Children and Adolescents, as well as of the transition between the homeland power and the family power, the current rules of this institute were studied in order to build a solid basis for understanding the role of parental authority and the principles that govern this burden imposed on parents.
