A presente dissertação analisa como a atuação do advogado Antônio Ferreira Martins contribuiu para a luta da classe operária de Pelotas (RS) contra o patronato no processo de implantação da Justiça do Trabalho. Durante o período da fase autoritária do governo de Getúlio Vargas, o Estado Novo, a sociedade brasileira vivenciou importantes mudanças sociais, culturais e econômicas. Dentro desta conjuntura, em 1939, formou-se em Direito Antônio Ferreira Martins. Filho de operário e militante do Partido Comunista do Brasil (PCB), o jovem Martins viu no Direito do Trabalho um novo campo a ser explorado profissionalmente. Além de possibilitar um bom retorno financeiro, esse campo permitia a conciliação de sua profissão a ideologias políticas. As noções classe, justiça (THOMPSON, 1987) são utilizadas para compreender o processo da participação ativa da classe operária na construção e regulamentação da legislação trabalhista brasileira. A discussão em torno do conceito “campo jurídico” (BOURDIEU, 2001) analisa como os atores sociais se movimentam neste espaço a partir das regras e convenções estipuladas neste campo. Por meio das reflexões sobre memória (CANDAU, 2011) e amparadas pela metodologia de História Oral Temática (MEIHY, 1998), foi utilizado na pesquisa três entrevistas que contribuíram para perceber diversas facetas do personagem pesquisado. As noções thompsonianas sobre Lei e Direito, contribuíram para a análise de pleitos judiciais em que o advogado Martins atuou. Por meio desta análise torna-se possível “pessoalizar” o campo jurídico, destacando quais eram suas estratégias de atuação e argumentação para captação e defesa de seus clientes.

His thesis examines how the role of the lawyer Antonio Ferreira Martins contributed to the struggle of the working class of Pelotas (RS) against employers in the implementation of the Labor Court process. During the period of authoritarian phase Getulio Vargas government, the Estado Novo, Brazilian society has experienced significant social, cultural and economic changes. Within this context, in 1939, he graduated in Law Antonio Ferreira Martins. worker's son and militant of Brazil's Communist Party (PCB), the young Martins saw the Labour Law a new field to be explored professionally. In addition to enabling a good financial return, this field allowed the reconciliation of their profession to political ideologies. Notions class, justice (Thompson, 1987) are used to understand the process of active participation of the working class in the construction and regulation of Brazilian labor legislation. The discussion around the concept of "legal field" (Bourdieu, 2001) analyzes how the social actors move in this space from the rules and conventions laid down in this field. Through reflections on memory (Candau, 2011) and supported by the methodology of History Thematic Oral (Meihy, 1998), it was used in the survey three interviews that contributed to perceive different aspects of the searched character. The thompsonianas notions of Law and Law, contributed to the analysis of legal claims in which the lawyer Martins served. Through this analysis it becomes possible "personalizing" the legal field, highlighting what their operating strategies and arguments to capture and defense of their clients.
