Visando esboçar uma interpretação das políticas de preservação do patrimônio documental bibliográfico no âmbito dos países do MERCOSUL, esta pesquisa contextualiza, analisa e confronta as leis que regulam o depósito legal em dois países do bloco, a saber: Brasil e Argentina. Para tanto, estabelece relações entre as formas de agir de cada país, dando especial atenção às missões de suas bibliotecas nacionais e a formação de seus acervos via depósito legal. Busca, também, contextualizar as práticas de preservação do patrimônio cultural dos países em questão e, para tanto, tece um comparativo entre as principais leis que regulam a proteção ao patrimônio cultural nos dois países. O estudo apresenta uma abordagem qualitativa e fez uso da revisão bibliográfica e documental para a construção teórica. A análise buscou comparar os sistemas propostos, identificando semelhanças e diferenças entre si. Os resultados da pesquisa demonstram que a cultura, de uma maneira geral, não tem ocupado posição de destaque nas ações e iniciativas do MERCOSUL. A presença dessa lacuna evidencia a necessidade de estímulo a estudos e pesquisas referentes à busca pela integração entre os países, dando a devida consideração às questões de ordem cultural, trazendo à tona a importância dos estudos voltados à preservação e à valorização do patrimônio cultural das nações. No que se refere às leis que regulam o depósito legal no Brasil e na Argentina, percebe-se que ambas necessitariam passar por ajustes de forma a se adequar às diretrizes propostas pela UNESCO.

Aiming to sketch out an interpretation of the policies for heritage preservation and documentary literature in the context of the MERCOSUR countries, this research contextualizes, analyzes and compares the laws regulating the legal deposit in two countries, namely: Brazil and Argentina. For both, establishing relations between the ways of acting of each country, giving particular attention to the missions of their national libraries and the formation of its collections via legal deposit. Search, also, to contextualize the practices of preservation of the cultural heritage of the countries concerned, and to that end, it weaves a comparison between the major laws that regulate the protection of the cultural heritage in the two countries. The study presents a qualitative approach and made use of the literature and documentary review for the theoretical construction. The analysis sought to compare the proposed systems, identifying similarities and differences among themselves. The results of the research demonstrate that culture, in general, has not occupied a prominent position in the actions and initiatives of MERCOSUR. The presence of this gap evidences the need to stimulate studies and research concerning the search for integration between countries, giving due consideration to cultural issues, bringing to the fore the importance of studies aimed at preserving and valuing the cultural patrimony of nations. With regard to the laws that regulate the legal deposit in Brazil and Argentina, it is noticed that both would need to undergo adjustments in order to conform to the guidelines proposed by UNESCO.
