O estudo tem por objetivo promover uma reflexão acerca da judicialização da saúde. Identificar disposições restritivas à concessão de medicamentos por meio de uma análise da jurisprudência das cortes superiores do Brasil. Compreender a possibilidade de conciliação de distintos interesses – a proteção aos direitos fundamentais e o compromisso pela responsabilidade fiscal. Especificamente, analisar o impacto da concessão de medicamentos e a observância dos direitos fundamentais nos julgados de concessão dos fármacos. O trabalho vale-se do método hipotético-dedutivo e está baseado em pesquisa bibliográfica selecionada a partir de publicações afetas à área da judicialização da saúde, economia, responsabilidade fiscal, direitos fundamentais e constitucional.

The study aims to promote a reflection on the judicialization of health. Identify restrictive provisions on the granting of medicines through an analysis of the jurisprudence of the superior courts in Brazil. Understand the possibility of reconciling different interests – the protection of fundamental rights and the commitment to fiscal responsibility. Specifically, analyze the impact of drug granting and the observance of fundamental rights in drug granting judgments. The work uses the hypothetical-deductive method and is based on bibliographical research selected from publications related to the area of judicialization of health, economics, fiscal responsibility, fundamental and constitutional rights.
