A presente pesquisa versa acerca da inclusão social da pessoa com deficiência no serviço público por intermédio de políticas de ações afirmativas as quais garantem a reserva de vagas para pessoas com deficiência em concursos públicos, sendo realizada a partir de levantamento qualitativo bibliográfico e documental sob a perspectiva dos Direitos Humanos e do reconhecimento social dos direitos da pessoa com deficiência. Para tanto, foi desenvolvido estudo da literatura e análise legislativa acerca das políticas públicas de ações afirmativas que permeiam os direitos da pessoa com deficiência preceituados na Constituição Federal, Tratados Internacionais, Legislação Federal Aplicável e Normativas Estaduais Complementares. O objetivo da pesquisa foi averiguar a aplicabilidade das políticas de ações afirmativas voltadas à inclusão e ao acesso das pessoas com deficiência ao serviço público, à medida que foi possível constatar a adoção dos percentuais em patamares ínfimos por parte da maioria das legislações estaduais.

This research is about the social inclusion of people with disabilities in public service through affirmative action policies which guarantee the reservation of vacancies for people with disabilities in public examinations, being carried out from a qualitative bibliographic and documentary survey under the perspective Human Rights and social recognition of the rights of people with disabilities. To this end, a literature study and legislative analysis was carried out on public affirmative action policies that permeate the rights of people with disabilities provided for in the Federal Constitution, International Treaties, Applicable Federal Legislation and Complementary State Regulations. The objective of the research was to investigate the applicability of affirmative action policies aimed at the inclusion and access of people with disabilities to the public service, as it was possible to verify the adoption of percentages at very low levels by most state legislations.
