No presente artigo, serão analisadas características da relação entre entregadores e empresas de aplicativos de delivery de comida, respondendo a dúvidas que existem quanto a esse tema: como essa relação é classificada de acordo com a legislação trabalhista vigente no Brasil, como funcionam esses aplicativos, como é feito o pagamento das entregas, detalhes contratuais e legais, a visão doutrinária sobre o tema, o entendimento dos tribunais brasileiros e a existência ou não de um vínculo empregatício.
In this article, common characteristics of the relationship between deliverymans and food delivery application companies will be analyzed, how this relationship is classified, according to the labor legislation in force in Brazil, the employment contract, the autonomous contract, how these applications work, how the payment of deliveries is made, contractual and legal details, the doctrinal view on the subject, the understanding of the Brazilian courts, in the end, say whether or not there is an employment relationship between deliveryman’s and delivery applications. The view of a Brazilian law student on a topic that raises doubts in the general population.
