O presente artigo analisou o endurecimento da Lei nº 8.072/90, oriunda de um período de tensão e divulgação de elevado aumento de crimes violentos no país. Ao cumprir com o mandamento constitucional do artigo 5º, XLII, o legislador instituiu um tratamento severo aos criminosos hediondos, restringindo garantias e aumentando penas. Desenvolveu-se um estudo do contexto da criação da lei, desde os projetos de lei ainda em tramitação na Câmara dos Deputados às principais mudanças legislativas já implantadas. Para tanto, utilizou-se da pesquisa exploratória, com estudo dos principais autores que tratam sobre a questão e coleta de dados na internet. Concluiu-se que a Lei dos crimes hediondos não apresentou efetividade no combate à criminalidade, malgrado o surgimento de inúmeras condutas e da aplicação de penas severas.

This article analyzed the hardening of Law No. 8,072 / 90, arising from a period of tension and disclosure of a high increase in violent crime in the country. In complying with the constitutional mandate of Article 5, XLII, the legislature instituted harsh treatment of heinous criminals, restricting guarantees and increasing penalties. A study of the context of the creation of the law was developed, from the bills still pending in the Chamber of Deputies to the main legislative changes already implemented. Therefore, we used exploratory research, with study of the main authors who deal with the issue and data collection on the Internet. It was concluded that the Law of heinous crimes was not effective in combating crime, despite the emergence of numerous conducts and the application of severe penalties.
