A presente dissertação versa sobre a norma da Constituição da República Portuguesa que consagra a recepção e aplicação, no ordenamento jurídico português, das normas que emanam do sistema jurídico da União Europeia. Para tanto, expor-se-ão os pressupostos de interacção entre ordenamentos jurídicos — o nacional e o da União Europeia — que conferem verdadeira utilidade a esta norma, seguindo-se o desvendar da sua natureza jurídica, de uma perspectiva analítica, bem como a sua relação com outras normas do orde-namento e as várias situações que possam gerar dúvida na sua aplicação, dado o frugal recurso dos tribunais em invocá-la. Em jeito de breve incursão, abordar-se-á o caso PSPP decidido pelo Tribunal Constitucional Federal Alemão, como paradigma que é do confronto e aceitação mútua entre ordenamentos jurídicos dos Estados-membros e o ordenamento jurídico da União Europeia, indagando, em simultâneo, pela natureza analítica das decisões judiciais. Procurar-se-á também pôr em evidência a aplicação que o Tribunal Constitucional tem feito das normas ora tratadas.
This dissertation deals with the norm in the Constitution of the Portuguese Republic that establishes the reception and application, in the Portuguese legal system, of rules emanat-ing from the legal system of the European Union. To this end, the assumptions of inter-action between both legal systems — the national and that of the European Union — which truly make this rule useful will be set out. Afterwards, we will unveil its legal na-ture, from an analytical perspective, and its relationship with other rules and with the various situations that may give rise to doubts about its application, given how infre-quently courts invoke these assumptions. Specifically, the PSPP case decided by the Ger-man Federal Constitutional Court will be analysed, as a paradigm of the confrontation of and mutual acceptance by the legal systems of the member states and the legal system of the European Union, while simultaneously investigating the analytical nature of these rulings. We will also seek to highlight the Constitutional Court's application of the norms set out above.
