Legitimidade civil : uma abordagem atualista

A legitimidade surge como sendo um conceito central na Teoria Geral do Direito Civil. Sem legitimidade a validade dos atos sai comprometida. A legitimidade é, deste modo, uma noção-quadro do Direito Civil. Para perceber a legitimidade é necessário percorrer um caminho que passará por perceber as suas diversas dimensões ambivalências. Será assim importante perceber alguns fenómenos associados à legitimidade, as consequências da sua falta, a sua distinção face a outras figuras relevantes na Teoria Geral do Direito (como por exemplo, a titularidade). O que é a legitimidade apenas pode ser entendido se se associar o seu estudo ao binómio titularidade e liberdade. A liberdade de que falamos resume-se à seguinte expressão de GALVÃO TELLES (TELLES, Inocêncio Galvão, Dos Contratos em Geral, 1ª ed., Coimbra, Coimbra, 1947) Cada um em sua casa é rei, e está nisto o fundamento e justificação da liberdade dos contraentes, que dentro de certos limites podem dar aos seus interesses e relações a regulamentação que lhes parecer mais vantajosa, sem invadir a esfera alheia, ou seja, a liberdade relevante para efeitos de conhecimento do que é a legitimidade é a liberdade que tem como limite a esfera jurídica de outrem e os direitos de outrem. Relevante é, ainda, perceber que nem sempre a titularidade e a legitimidade poderão reunir-se na mesma pessoa. Há situações em que há titularidade e não há legitimidade. A legitimidade pode ser direta e indireta. A legitimidade indireta é outro meio de compreendermos a legitimidade, destacando-se as figuras da procuração, autorização, substituição e legitimidade de facto. Refira-se que as figuras da substituição e da legitimidade de facto. Na compreensão da legitimidade aparente ou de facto surge um importante contributo da boa fé, um dos princípios basilares de Direito Civil, a par do principio da autonomia privada. Por fim, é importante perceber o que é a legitimidade, afinal, se uma qualidade, se uma posição jurídica.

The legitimacy appears like being a central concept in the General Theory of the Civil law. Without legitimacy the validity of the acts goes out busy. The legitimacy is, in this way, a notion-picture of the Civil law. To realize the legitimacy it is necessary to follow a way that will pass because of realizing his several dimensions ambivalence. It will be so important to realize some phenomena associated to the legitimacy, the consequences of his lack, his distinction face to other relevant figures in the General Theory of the Right (I eat for example, the ownership). What is the legitimacy hardly can be understood if his study will be associated to the binomial titularidade and freedom. The freedom about which we talk consists in the next expression of GALVÃO TELLES (TELLES, Inocêncio Galvão, Of the Contracts in General, 1st ed. Coimbra, 1947) Each one at his home is a king, and there is in this the basis and justification of the freedom of the counterbeings, who inside certain limits can give to his interests and relations to regulations that to seem more advantageous to them, without invading somebody else's sphere, in other words, the relevant freedom for effects of knowledge of what is the legitimacy is the freedom that takes as a limit the legal sphere of somebody else and the rights of somebody else. Relevant is, still, to realize that not always the ownership and the legitimacy will be able to be joined in the same person. There are situations in which it has titularidade and there is no legitimacy. The legitimacy can be straight and indirect. The indirect legitimacy is different way of we understand the legitimacy, when the figures of the procuration are standing out, authorization, substitution and legitimacy in fact. One tells that the figures of the substitution and of the legitimacy in fact. In the understanding of the apparent legitimacy or in fact there appears an important contributo of the good faith, one of the basic beginnings of Civil law, the couple of the beginning of the private autonomy. For end, it is important to realize what is the legitimacy, at last, if a quality, if a legal position.
