Esta dissertação analisa a aplicação da categoria violência pelo Supremo Tribunal Federal como um descritor para a ocupação de terras – estratégia de luta adotada por movimentos sociais de trabalhadores rurais sem terra na reivindicação pela reforma agrária. Proponho que no pensamento político de matriz liberal a violência é constituída como um rótulo negativo que implica no esvaziamento do conteúdo político de uma ação. Assim, a definição de um ato como violento ou não é uma decisão submetida à dinâmica das relações de poder e não um dado objetivo da realidade. Dessa forma, examino a descrição da ocupação de terras como um ataque violento ao direito de propriedade que perpassa a decisão do STF na ADI 2.213-0 em sede cautelar. Para que se possa evidenciar a arbitrariedade na definição da violência no conflito agrário, realizo uma breve análise sobre os principais diplomas legais que regularam a apropriação fundiária na história brasileira e as políticas públicas de reforma agrária. Com base nas reflexões de Frantz Fanon, Slavoj Žižek e Walter Benjamin discuto a postura refratária das instituições estatais às demandas formuladas por grupos historicamente excluídos dos espaços oficiais de disputa política no Brasil.

This thesis analyzes the application of the category violence by the Brazilian Constitutional Court as a descriptor for the land occupation – strategy adopted by social movements of rural landless workers in the struggle for land reform. I propose that in the political thought of liberal matrix violence is constituted as a negative label which implies voiding the political content of an action. The definition of an act as violent or not is a decision subject to the dynamics of power relations and not an objective fact of reality. Thus, the description of land occupation as a violent attack on property rights, that permeates the Supreme Court decision in the ADI 2213-0, is examined. In order to highlight the arbitrariness in the definition of violence in the agrarian conflict, a brief analysis of the key legislation that regulated the land ownership and public policy of land reform in Brazilian history is carried out. Based on the reflections of Frantz Fanon, Slavoj Žižek and Walter Benjamin, the refractory attitude of state institutions to the demands made by historically excluded groups from the official spaces of political dispute in Brazil is discussed.
