O presente trabalho visa analisar as modificações ocorridas no instituto do poder familiar e sua destituição. Inicia-se o estudo pela gênese deste instituto jurídico, perpassando as legislações nacionais pertinentes ao tema e expondo o conceito atualmente aceito de poder familiar. A destituição do poder familiar é analisada em suas hipóteses de aplicabilidade, bem como o procedimento para sua concretização. A problemática se apresenta através da constatação da morosidade do procedimento como entrave à adoção. Diante disso, é analisado o acórdão do Agravo de Instrumento nº 70076485424, da Oitava Câmara Cível, tendo como relator o Des. José Antônio Daltoé Cezar que apresenta a possibilidade de colocação da criança em Cadastro Nacional de Adoção antes de finalizada a destituição do poder familiar, como medida excepcional.
This paper aims to analyze the changes concerning the institute of family power and its dismissal. The paper begins by studying the genesis of this legal institute, going through national legislations pertinent to the subject and exposing the currently accepted concept of family power. The dismissal of family power is analyzed in its hypotheses of applicability, as well as the procedure for its implementation. The problem arises through the finding of the length of the procedure as an obstacle to adoption. Therefore, the judgment of Agravo de Instrumento nº 70076485424, of the Eighth Civil Chamber, is analyzed, with Des. José Antônio Daltoé Cezar, who presents the possibility of placing the child in the National Registry of Adoption before the end of the destitution of family power, as an exceptional measure.
