O regime jurídico das pensões de velhice no direito português da Segurança Social
| Resumo: | The social security regime of the retirement in Portugal, i.e., the «reforma de velhice», in the Portuguese legal terminology, lays its regulation in a key concept, which is the regular age to access the retirement pension. This concept crosses all the legal regime and focus on the evolution of the average life expectancy which varies over time. The importance of such key concept presents itself in the several special regimes, such as the flexibility (early and assisted) of access to the retirement pension and in the special retirement regime based on a long-term unemployment, which have different requirements and regimes regarding the setting of the pension. // O regime jurídico da segurança social da jubilação em Portugal, isto é, da «reforma de velhice», na terminologia jurídica portuguesa, assenta toda a sua regulamentação num conceito chave, que é o da idade normal de acesso à pensão de velhice. Este conceito é transversal a todo o regime jurídico e centra-se na evolução da esperança média de vida, variando ao longo do tempo. A importância de tal conceito chave revela-se nos vários regimes especiais, como sejam o da flexibilidade (antecipada e bonificada) de acesso à pensão de velhice e no regime especial de reforma por desemprego de longa duração, os quais têm requisitos e regimes distintos de fixação da pensão. |
