In this paper, the ideas are exposed in the following way: firstly, it is shown some of the special concepts of the Hans-Georg Gadamer’s (1900-2002) philosophical hermeneutic, such as foreunderstanding (Vorverständnis), tradition (Tradition), historically consciousness (Wirkungsgeschichte), fusion of horizons (Horizontverschmelzung) and language; then, it is discussed Gadamer’s role in the so-called “hermeneutic turn” and the way man and language are faced within of view; finely, also throught a gadamerian perspective, it is described the creative and productive function of the jurists while interpretating and applying the Law. The conclusion is based on the fact that, in the every step of interpretative process, including legal interpretation, language is an element presupposed by the occurrence of the interpretation itself.

Neste artigo, as idéias estão divididas da seguinte forma: primeiro, são expostos alguns dos principais conceitos da hermenêutica filosófica de Hans-Georg Gadamer (1900-2002), como pré-compreensão (Vorverständnis), tradição (Tradition), consciência histórica (Wirkungsgeschichte), fusão de horizontes (Horizontverschmelzung) e linguagem; depois, é discutido o papel de Gadamer na “reviravolta hermenêutica”, e como, a partir de sua teoria, são encarados o homem e a linguagem nessa mudança de perspectiva; e, finalmente, é traçado, também sob a visão gadameriana, o papel criativo e produtivo dos juristas na interpretação e aplicação do Direito. A conclusão se sustenta no fato de que, em todo o caminho da interpretação, inclusive no Direito, a linguagem é o elemento pressuposto para o “acontecer” da própria interpretação.
