A crescente utilização do sector aeronáutico internacional por parte de organizações ligadas ao terrorismo, ao narcotráfico e ao crime internacional organizado veio mostrar as fragilidades do sistema evidenciando a necessidade de uma maior vigilância, segurança e protecção do espaço aéreo. Portugal não é excepção, aliás, a localização geoestratégica de Portugal coloca o espaço aéreo de jurisdição nacional na confluência das rotas aéreas que ligam a Europa ao continente americano e a África. Nesta linha, este estudo insere-se numa área de investigação ao nível legislativo e da organização dos serviços com responsabilidade na segurança e protecção do sector aeronáutico nacional. O estudo aborda primeiramente a caracterização das vertentes principais do sector aeronáutico nacional tendo em consideração os organismos reguladores a nível nacional e internacional, evidenciando que a coordenação e a circulação de informação entre todas as entidades envolvidas são fundamentais para uma segurança e protecção efectiva das actividades aéreas nacionais. Por outro lado, o Sistema de Autoridade Aeronáutica, apesar de estar previsto na lei há mais de 23 anos, carece de legislação própria no ordenamento jurídico nacional. Assim sendo, procedemos à avaliação da estrutura organizacional que se considera mais adequada à realidade nacional, efectuando a sua caracterização, analisando as suas competências, organização funcional e transversalidade entre todos os organismos que devem fazer parte integrante do Sistema. Face ao vazio legal existente e adequada às especificidades nacionais, surge a necessidade de implementação organizacional de um modelo de Autoridade Aeronáutica Nacional, prevista no ordenamento jurídico nacional mas que carece de regulamentação própria. De acordo com o paradigma português, face à legislação em vigor, apresentamos neste estudo um modelo conceptual para a Autoridade Aeronáutica Nacional, inserida no Sistema de Autoridade Aeronáutica, aproveitando o conhecimento, as valências e os serviços já existentes na Força Aérea, numa perspectiva de duplo uso, racionalizando os recursos globais do estado (humanos e financeiros) e maximizando a relação custo-eficácia. Abstract: The increasing use of the international aeronautical sector by terrorist organizations, drug trafficking and organized international crime opened up the vulnerabilities of the system emphasizing the need of a wider surveillance, more safety and security of the airspace. Portugal hasn’t been an exception. As a matter of fact its geostrategic situation has put the airspace of national jurisdiction in the confluence of the air routes which connect the American continent and Africa. This study is part of a research area concerning both the legislation and the organization of services with responsibility in the safety and protection of the national airspace. Through the characterization of the main areas of the national aeronautical sector taking into account the regulatory national and international organisms, the study shows that the coordination and the circulation of information between the entities involved are crucial for an efficient safety and security of the national air activities. Moreover, the Aeronautical Authority System lacks legislation in the national legal system although it’s expected to have its own legislation for more than 23 years. Therefore we evaluated the organizational structure that we consider best suited for the national reality, we characterized it and studied its skills, the functional organization and the transversality among all the organisms which should be part of the System. In a word, because of this legal omission it seems clear that a conceptual model of National Aeronautical Authority adapted to the national situation needs to be implemented. Thus, according to the Portuguese paradigm, we present in this study a conceptual model for the National Aeronautical Authority, included in the Aeronautical Authority System, that leverage the knowledge and the services already existing in the Portuguese Air Force in a double use perspective making the most of the global governmental resources (human and financial) and the cost-effectiveness relation.
