The principle of reciprocity and foreign direct investment in the EU

Resumo:The Article examines the recent developments in the law governing Foreign Direct Investment in the European Union and the possible reciprocation of investment barriers. It contemplates how reciprocity could be considered by authorities as a factor in screening procedures and compares it with the “security related factors”. It scrutinizes two amendments proposed by committees of the European Parliament that suggested to apply the principle of reciprocity in screening procedures. Ultimately the advantages and disadvantages of a reciprocity initiative in FDI are being discussed and a comparative look is taken at the attempt of the Commission to establish reciprocity in public procurement
