International migration and trends in its regulation
| Resumo: | In this article, we seek to discern the global trends in policies and legal regimes applicable to international migration. We identify four fundamental trends: the duality of regimes, which insist on a sharp distinction between refugees and other migrants; the fragmentation of regimes applicable to foreigners under a multiplicity of statutes that are difficult to navigate; the externalization of migration controls; and the fight against some (very numerically significant) migratory movements, often resorting to criminalization for this purpose. |
