| Resumo: | The States tend to be incapable of responding in terms of social public policies, to the various existing social problems, since they face financial, social, and political challenges. Thus, they face, financial challenges, as States have, inter alia, budgetary constraints both internally and externally. With social challenges, because the new social problems appear in increasing numbers and more complex forcing the adoption of new social responses and the transformation of many of the existing ones. And also, with political challenges, because public policies have several problems both at the time of their conception, as at the time of execution, monitoring and their subsequent control. It is in this context that, increasingly, an appeal has been made for join and articulated action between the State, the Private and Social Agents through action in Partnership. Action that, established, namely, through a contract, should be based on sharing of resources, risks, responsibilities, and powers to the detriment of the mere transfer of competence typical of the Cooperation action. At the same time, the appropriate Partnership is structured for the medium/long terms and that is always implemented by two or three in public policies, that is, from the initial moment of policy design, through implementation and monitoring and finalizing with the control of the results. The public action thought Partnerships has multiple advantages, such as the fact that they are alternatives to public financing, allow the State to achieve more innovate, appropriate, effective, and efficient solutions in social matters and, reduce the risks of corruption and fraud in matters of social public policies. However, these Partnerships also have disadvantages that need to be taken care of to enable them to be effective and efficient. Thus, we will elucidate how the join action of the State with the Private and Social Agents can be critical for the fulfilment of the various state obligation in matters of social rights. In the end, it is clear for the strengthening of these Partnerships since public intervention must build on them. |
