Profissionalização da contratação pública em Portugal

Resumo:Public Procurement is the activity through which public administrations acquire works, goods, and services for the citizens, fundamental to promote economy and achieve politicai objectives. This dissertation provides an insight into public procurement in Portugal, relating regulation, performance of the activity and knowledge/skills of the professionals who, although working in procurement, do not have their own career. The research gains particular relevance and opportunity in view of: (i) the scarcity of studies on this topic in Portugal; (ii) evidence of lack of performance, knowledge and skills in the activity; (iii) the current context of public policies (e. g. Recovery and Resilience Plan) favourable to the creation of a structure of competencies and strengthening of the training offer; and (i v) possibility of using the instruments provided by the European Commission to enhance the role of public procurement professionals. The study integrates a literature review, an approach on some topics of the regulation of the activity, empirical data, and an analysis of the level of knowledgelskills of the professionals obtained by a questionnaire. The questionnaire carried out can be considered a pilot study on a set of professionals working in public procurement. The results propose that there is public procurement that is not advertised, which suggests that there may be fractional expenditure that is not subject to market competition. The preference for email invitation procedures does not encourage the use ofnew techniques recommended by the European Commission to promote competition. There are recognised shortcomings in terms of knowledge and skills. Thus, it is concluded that professionalisation is necessary to increase the administrative capacity of public entities. It is necessary to define the concept of professional, with proper regulation, recruitrnent and career that identifies competences and ethical standards for the exercise of functions in the activity with efficient and effective performance.
